Please read these Terms and Conditions (Terms or Terms and Conditions) carefully before using our services (the Service) offered by Sortter Ltd (Sortter, us, we, or our).  

Your access to and use of our Service is conditional on your acceptance of and compliance with these Terms. These Terms apply to all users and others who access or use our Service. The Service is offered to you free of charge. 

By accessing our Website and using our Service you agree to be bound by these Terms. If you disagree with any part of the Terms, then you must not access our website.

Sortter Ltd is a private limited company registered under the laws of Finland under the business identity code 2954352-7, with its registered address Bulevardi 21, 00180 Helsinki, Finland.

1.1      These Terms govern the relationship between you and us, detail our obligations towards you and your obligations towards us.

1.2      The relationship between you and us shall be governed and is conditioned by:   

  • the information and declarations made by yourself during the registration as ‘User’ as well as other declarations and confirmations made during the relationship;  
  • these Terms.

1.3      If any of the documentation sent to you when you start to use our Service contradicts any of the conditions set out in these Terms, the content sent to you within that other documentation will prevail.  

1.4      When you use our Service, you and your prospective joint applicant agree to these Terms and Conditions. You must inform joint applicant of these Terms and Privacy Policy and obtain his or her authorization to agree on these Terms on joint applicant’s behalf and consent to transfer their personal data to us and process them in accordance with Privacy Policy. By submitting information of joint applicant, you confirm that you have received an appropriate authorization and consent of your joint applicant and assume liability in case of failure to comply with this requirement.

In the future, when we use the term "you" (with different forms of bending), this includes a potential joint applicant linked to you as well.

Acceptance of Terms means that you give us mandate to request offers from our partners for loans or money remittance, crypto brokerage, investment, mobile wallet or other services that you wish to use and that are available in the Service on your behalf at the time the application is made. You also agree that we will forward the information you provide, or we collect from our partners to us in co-operation with the application regarding services only to the extent necessary for execution of the Service.

1.5      We may change these Terms from time to time. We will update you with any amendments to these Terms and inform you possibly in advance.   

1.6      You will be notified of the updated Terms by us posting it on our Website.

1.7.     In order to use the Service, you need internet connection. Depending on your internet services payment plan, it might be subject to a charge.

In these Terms and Conditions, the words in bold below have the following meanings:  

Sortter: a private limited company registered under the laws of Finland under the company registration no.: 2954352-7, with its registered Bulevardi 21, 00180 Helsinki, Finland. Sortter is registered with the trade register and its main line of business is other activities auxiliary to financial services, except insurance and pension funding.

Customer Service: the support service centre that can be reached by e-mail at asiakaspalvelu@sortter.com.

           EEA: The countries within the EU, together with Liechtenstein, Norway and Iceland.  

Online Application: the online form you need to complete in order to apply for loans or services provided by our partners. This can be completed on our Website.   

Service: the online service where, based on your Online Application, we intermediate loans or request offers from our partners for money remittance, crypto brokerage, investment, mobile wallet or other services that you wish to use and that are available in the Service on your behalf and which we agree to provide to you under these Terms.  

Terms or Terms and Conditions: means the terms and conditions concerning our Service contained in this document.  

We, us, our: Sortter Ltd as defined above.  

Website: the commercial website, currently www.sortter.com (or any other URL as we may notify to you from time to time).  

You, your, yours: means the person, the user who now or hereafter subscribes to services offered by us.  

3.1      Our Service is available for natural persons of at least 18 years of age, and for trusts, companies and other bodies corporate or charities too.  

3.2      To make applications for the loans or services of our partners which are available in the Service, you may need to complete the Online Application.

We reserve the right to put on hold your Online Application immediately should certain circumstances be deemed by Sortter to have become exceptional. Examples of these circumstances would be if:  

  • you have not met our conditions relating to verification of your address;  
  • we reasonably suspect that you or someone else are using your data illegally or fraudulently;  
  • you have at any point in time provided us with false information;  
  • you have refused or ignored to provide specific information requested, or failed to complete and send to us specific confirmations or declarations;
  • you are in breach of any of these Terms and Conditions; or  
  • we are expressly requested by relevant competent authorities to freeze your Online Application.  

3.3      Please note that the acceptance of your Online Application is solely based on our partners own assessment, not ours.

3.4      Consents and authorizations relating to intermediation of loans

You agree that the credit decision obtained on the Online Application for a loan will be available on our Website under “My offers”.

You accept that we and/or our partner acting as the credit provider reviews or revises the credit information of you and that the information provided by you in the Online Application can be verified.

You authorize us to obtain information on the credit decision of our partner acting as the credit provider and to obtain additional information from the credit providers on the credit decision. Acceptance of this is necessary in order for us to carry out our mandate as an intermediary.

Please note that our partners acting as credit providers may, for their part, contact your employer or search for public records to verify the information you submit.

We are not liable for content of any information provided on our Website that relates to loans or services offered by our partners.

We are not liable for any breaches of these Terms and possibly resulting damages arising from a force majeure event, such as government activities, war, strike, lockout or other similar events. For other reasons, so far as permitted by the applicable law, we are not liable for damages if we have followed normal caution and we are not liable for any indirect or consequential damage.

When applying for a loan, it is important that you always check the exact amount of your own income and cost of living so that you can calculate a monthly instalment or other commitment of the appropriate amount for the loan applied for.

By using our Service, for example by visiting our Website or searching for a loan or a service offered by our partners , you confirm that you have read and understood our Privacy Policy and that our current Privacy Policy is part of your contract with us beside these Terms.

You acknowledge that we shall process your personal data for the purposes set out in these Terms, in our Privacy Policy in accordance with the Regulation (EU) 2016/679 (the “GDPR”), data protection laws and in order to comply with legal obligations to which we are subject to. We also store information about how you use our Service, such as the search channel you use, the time of the application, the dates of our contacts, and what the contact was about. When applying through digital channels, we use cookies and other digital tools to optimize, track, and track search results so that we can provide you with a good and meaningful user experience. If you apply for a loan through us, we will disclose your personal information to our partners who cooperate with our Service and are relevant to your application. Each partner is the controller for the processing of your personal data by your application. You will therefore be advised to read carefully the information provided by the partners on how they handle personal data.

6.1      You have a right to withdraw from the agreement with Sortter which is based on these Terms within 14 days of the date of acceptance thereof. For the avoidance of doubt, you cannot withdraw an Online Application after you have submitted it. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.  

6.2      The right of withdrawal may be exercised by contacting our Customer Service. Your communication must at least include a statement showing an explicit intent to withdraw from the agreement with Sortter which is based on these Terms.   

6.3      Our Service is valid for an unlimited time period after you have made your first Online Application. You can terminate the Service at any time by sending an email to our Customer Service (asiakaspalvelu@sortter.com).   

7.1      These Terms and the relationship between you and Sortter are governed by Finnish law, save for its choice of law regulations.

7.2      You have certain rights in accordance with the consumer rights protection law, including in the event the Service does not comply with the Terms. Any complaints you may have are to be sent via email to:  

asiakaspalvelu@sortter.com.   

7.3      We will try to resolve your complaint as soon as is reasonably possible. In the event that the matter will require more attention to be resolved, we will take your details and arrange for your complaint to be fully investigated and addressed as soon as possible. 

7.4      If there is a disagreement between you and Sortter about the Terms that cannot be resolved through negotiation, the dispute will be resolved in the district court of your domicile or, if you wish, in the district court of Sortter’s domicile. If you are not domiciled in Finland, disputes will be handled in the district court of Sortter's domicile.

7.5      You are also entitled to raise disputes arising out of these Terms and Conditions via alternative dispute resolution, provided that the dispute fulfils the requirement thereof. We undertake to contribute to alternative dispute resolution with customers under the law on alternative dispute resolution in consumer relations. In Finland, the consumer disputes are handled by:

Before taking the matter to the Consumer Disputes Board, contact the Consumer Advice Service (www.kuluttajaneuvonta.fi).

7.6      The European Commission has developed a platform for dispute resolution out-of-court. This enables the customer to resolve dispute in connection with online orders, without having to initiate a court proceeding. 7.7      These Terms do not reduce your rights under the consumer rights protection law. Preliminary information about Sortter's Service has been provided in accordance with Finnish law.

Sortter is supervised by the Consumer Ombudsman and the Finnish Competition and Consumer Authority (www.kkv.fi).
